The Criminal Code or the Criminal Code is a statutory regulation governing material criminal acts in Indonesia. The current Penal Code is the Penal Code which originates from Dutch colonial law, namely Wetboek van Strafrecht voor Nederlands-Indië. Ratification was made through Staatsblad Year 1915 number 732 and came into force on January 1, 1918. After independence, the Criminal Code continues to be applied accompanied by harmonizing conditions in the form of revocation of articles that are no longer relevant. This is based on the Transitional Provisions of Article II of the 1945 Constitution which states that: "All existing state bodies and regulations are immediately enforced as long as no new provisions have been made according to this Constitution." These provisions then became the legal basis for the enactment of all statutory provisions during the colonial period during independence.

To reaffirm the implementation of criminal law during the colonial period, on February 26, 1946, the government then issued Law Number 1 of 1946 concerning Criminal Law Regulations. This law was then used as the legal basis for the change of Wetboek van Strafrecht voor Netherlands Indie to Wetboek van Strafrecht (WvS), which became known as the Criminal Code. However, Article XVII of Law Number 1 Year 1946 also states that: "This law shall take effect for the islands of Java and Madura on the day it was announced and for other regions on the day to be determined by the President." Wetboek van Strafrecht voor Netherlands Indie became Wetboek van Strafrecht only limited to the regions of Java and Madura. The enactment of the Indonesian Criminal Code in all regions of the Republic of Indonesia was only carried out on September 20, 1958, with the enactment of Law No. 73 of 1958 concerning Stating the Enactment of Law Number 1 of 1946 of the Republic of Indonesia concerning Criminal Law Regulations for the Entire Territory of the Republic of Indonesia and Amending the Criminal Code. As stated in Article 1 of Law No. 7 of 1958 which reads: "Law No. 1 of 1946 the Republic of Indonesia concerning Criminal Law Regulations declared valid for the entire territory of the Republic of Indonesia. "So, as of January 1, 2013, the Criminal Code has been valid for 95 (ninety-five) years.

Although the Criminal Code has been enacted nationally does not mean that efforts to create a new criminal law system have stopped. Efforts to reform the criminal law have been ongoing since 1958 with the establishment of the National Legal Development Institute as an effort to form a new National Penal Code. The National Law Seminar I, which was held in 1963, has produced various resolutions including the insistence on completing the National Penal Code in the shortest possible time.
