THIS AGREEMENT IS A LEGAL DOCUMENT THAT ESTABLISHES THE TERMS AND CONDITIONS FOR THE USE OF THE APKPURE PREMIUM SUBSCRIPTION SERVICE. PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PROCEEDING WITH THE SUBSCRIPTION PROCESS OR USING THE SERVICES. BY REGISTERING FOR OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT, YOU MUST NOT SUBSCRIBE OR USE THE SERVICES.
This Agreement ("Agreement") is entered into by and between APKPURE ("Platform") and the user ("User" or "you") and governs the User's acquisition and use of the APKPURE PREMIUM subscription services ("Subscription Services") provided by the Platform. The Subscription Services offer additional functionalities not available in the free version.
Users purchase the APKPURE PREMIUM will get the following exclusive service.
To access the APKPURE PREMIUM Services, the User needs to register a User Account with APKPURE, please follow the APKPURE Registration Process. Throughout the procurement of the APKPURE PREMIUM Services, the User is requested to furnish the additional information solicited, including Email address and pertinent payment details such as Card number, Cardholder name, and other specifics which will be collected by the payment Channel such as Stripe and APKPURE has no knowledge for the said details, as per the instructions that will be provided on the Platform.
Certain Services such as APKPURE PREMIUM, as perpetually indicated on the Website or the Application, are required to be procured by the User (hereinafter referred to as the “Services for Purchase”). These Services for Purchase are offered, where applicable, through the Website or within the Application, with the relevant particulars being detailed therein. APKPURE reserves the right to modify the portfolio of Services for Purchase at its discretion from time to time.
If the User wishes to acquire Services for Purchase, the User shall simply follow the indications, as appropriate, on the Website. Any condition or term shown during the process of contracting the specific Service for Purchase shall be applicable.
Prices for the Services for Purchase are displayed, as applicable, on the Website, in the relevant currency to the transaction and include, when required, the Value Added Tax applicable to the transaction depending on the place of delivery and residence of the User.
APKPURE retains the prerogative to alter the pricing of its Services for Purchase at any given moment, yet it shall adhere to the prevailing price at the time of the User's placement of an order. Prior to the confirmation of the order, the culmination of the purchasing process, and the execution of payment, the User will be duly notified of the comprehensive final price, encompassing all applicable charges. Upon the completion of the Services for Purchase, APKPURE shall issue a confirmation via electronic correspondence to the email address affiliated with the User's Account, thereby acknowledging the transaction of the Services procured.
The Terms, as well as any particular conditions applicable to the Services for Purchase may be printed by the User during the contracting process. Likewise, a proof of payment in digital format will be generated and the User may consult the payments at any time in the Account through the Platform.
The User is entitled to remit payment for the Services for Purchase utilizing the payment methods accepted periodically, as delineated within the procurement process. In order to effectuate the payment, the User is required to adhere to the directives presented on the Platform.
In the event that Users opt to make payments via credit card, it is incumbent upon them to furnish the requisite card particulars. Transactions conducted with credit cards are facilitated through a secure system that employs encryption to safeguard the transmission of banking details over the Internet. The activation of the Services for Purchase is contingent upon the receipt or authorization of payment by the pertinent financial entity. The administration of payment information is conducted exclusively between the third-party platforms; under no circumstances will APKPURE intervene or gain access to the Users' banking data.
6.1 Cancellation by User: The User may cancel the Subscription Services at any time, and such cancellation will take effect at the end of the then-current subscription month. Upon exercising the right of cancellation, all forthcoming monthly subscription payments shall be annulled, and the fees associated with the APKPURE PREMIUM for the current month shall remain non-refundable.
To assert the right of withdrawal, the User must communicate their decision unequivocally. The User shall avail themselves of the withdrawal form on APKPURE PREMIUM page.
Furthermore, it is hereby expressly acknowledged and accepted by the User that the right of withdrawal shall not be applicable in instances where the Service for Purchase has been fully rendered, or when the Service for Purchase entails the provision of digital content in a non-material form, and the User has granted consent for the supply of such digital content. Should the Service for Purchase have been partially rendered, the User shall be liable for the portion of the Service for Purchase that has already been provided up to the point of exercise of the right.
6.2 Termination by Platform:The Platform reserves the right to terminate the User's subscription immediately if the User breaches any term of this Agreement.
The Subscription may intermittently offer a complimentary trial period, enabling the User to utilize the extra functionalities without incurring charges. Upon the conclusion of the trial period, the Subscription shall automatically become effective at the prevailing rate from the day following the free trial's end, and the applicable fee will be levied unless the Subscription is terminated by the User.
By procuring the Subscription, the User hereby grants APKPURE the authority to debit the corresponding fee through the selected payment method. With the exception of free trial periods, the Subscription will not be activated until payment has been received or authorized by the pertinent financial institution. Thereafter, the Subscription will remain active for the duration stipulated by the User.
The Subscriptions are subject to automatic renewal at the prevailing price upon the expiration of their term, continuing successively until the Subscription is canceled by the User.
APKPURE retains the right to alter the Subscription price applicable to renewals or to amend the terms governing the Subscription (including its cancellation), provided that it furnishes the User with notice at least one month in advance of the implementation date.
8.1. Ownership: The Platform retains all right, title, and interest in and to the Subscription Services, including all intellectual property rights therein.
8.2. User Content: The User retains all rights in and to any content they provide through the Subscription Services.
The Platform is committed to respecting the User's privacy and will handle any personal information in accordance with its Privacy Policy.
THE SUBSCRIPTION SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
IN NO EVENT SHALL THE PLATFORM BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SUBSCRIPTION SERVICES, WHETHER OR NOT ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This Agreement is governed by and construed in accordance with the laws of Singapore. Any disputes arising out of or in connection with this Agreement shall be subject to the Terms of Use of APKPURE.
13.1. Severability: If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.
13.2. Assignment: The User may not assign any rights or delegate any obligations under this Agreement without the prior written consent of the Platform.
13.3. Entire Agreement: This Agreement constitutes the entire agreement between the User and the Platform with respect to the Subscription Services and supersedes all prior agreements, proposals, and communications, whether written or oral.
The Platform reserves the right to modify the terms of this Agreement at any time. The User will be notified of any changes, and their continued use of the Subscription Services will constitute acceptance of the revised Agreement.
IN WITNESS WHEREOF, THE PARTIES HAVE DULY EXECUTED THIS AGREEMENT AS OF THE DATE OF REGISTRATION.
